BUSINESS DEFAMATION
The Wedding Planner
Our client was hired to plan the wedding of the defendant, and this led to disputes over services, payments, and social media crediting. The claimant faced difficulties with wedding arrangements, including weather-related challenges but still managed to deliver the services to the defendant. Despite this, the defendant criticized the planner on Instagram and credited suppliers but not the claimant. This in itself implied something was wrong with the claimant's work. A newspaper article about the wedding was also written in a popular tabloid newspaper which made false statements about our client. We wrote a letter before action to the defendant and the parties engaged in without prejudice discussions to resolve the matter which resulted in the defendant stopping in her statements and credits to third parties to disgrace our client. A successful result.
Who Do I Sue for Internet Defamation?
The law is complex. Our focus in every case is to get the offending material taken down as quickly as we can. This includes seeking urgent removal from search engine results.
Our first step is to approach the person who posted the material (if known). We will also approach the publisher – the website operator or host – who may have an interest in removing material because of their potential liability under UK defamation law.
Our initial letter will:
State the precise nature of the defamation
Request the immediate removal of the material from all internet locations in which it appears
Indicate our intention to instigate legal proceedings if our requests are not met
