In this matter, we represented the claimant. The claimant was a daycare nursery with over 30 years of childcare and a strong reputation for offering quality services to parents and children. The Office for Standards in Education, Children's Services, and Skills (Ofsted) also regulates the claimant.
The defendant intended to enrol her child in the nursery. She started the registration procedure and paid her deposit. She was also given the nursery's terms and conditions to sign before finishing the registration procedure. After reviewing the terms and conditions, the defendant objected to them and refused to sign them.
After many requests from the claimant to the defendant to sign the terms and conditions, the claimant decided to withdraw its offer so that the defendant might explore other nurseries with terms and conditions acceptable to the defendant. Following the claimant's decision, the defendant became enraged and posted a fake and extremely defamatory Google review on the Nursery’s Google My Business Page about the claimant in order to ruin its reputation and business.
A robust letter before claim (cease and desist) was sent to the defendant who, upon receipt of it, realised its significance and removed the posts.
