BUSINESS DEFAMATION
The Construction Company
In this case, we acted for a construction company that entered into a contract with the defendant for refurbishment and construction work at a property. The project began in September 2020 and was completed in June 2021. A dispute arose over the final payment, leading to an adjudication process.
The architect issued various documents related to the final payment, resulting in a balance due from the claimant to the defendant. The claimant disputed this, leading to an adjudication process initiated by the defendant. The adjudicator ultimately ruled in favour of the claimant, but the defendant refused to comply with the decision and only paid after legal proceedings were initiated.
Following the resolution of the payment dispute, the defendant embarked on a campaign of making false, malicious, and defamatory statements about the claimant on social media platforms. We reviewed all the videos and images and wrote a strong letter before claim to the defendant detailing the defamatory aspects of the images and meanings conveyed; the defendant removed the images. A successful outcome for the client.
BUSINESS DEFAMATION
We acted as legal representatives for the claimant, a reputable mobility scooter brand. The claimant alleged that the defendant conducted a malicious and false defamation campaign against them on social media, specifically on Facebook and Trustpilot. Despite the claimant's efforts to address the issue and provide a refund, the defendant continued to make damaging statements. We wrote a letter before action claim to the defendant who upon receipt of the letter, removed the false and defamatory statements made against our client.
BUSINESS DEFAMATION
We acted on behalf of the claimant, a highly reputable Oculofacial Plastic Surgeon. The respondent, who made false and defamatory comments on Google Reviews, caused significant distress and potential financial harm to the claimant's practice. The respondent's actions arose from a dispute over a request for free advice, which led to a malicious and defamatory review. We sent a letter before action to the defendant which resulted in the defendant removing her defamatory reviews. This client was particularly grateful because of the damaging nature and impact of the review on his business as a cosmetic surgeon and he knew that the defendant was very difficult. He was very pleased with the outcome.
Who Do I Sue for Internet Defamation?
The law is complex. Our focus in every case is to get the offending material taken down as quickly as we can. This includes seeking urgent removal from search engine results.
Our first step is to approach the person who posted the material (if known). We will also approach the publisher – the website operator or host – who may have an interest in removing material because of their potential liability under UK defamation law.
Our initial letter will:
State the precise nature of the defamation
Request the immediate removal of the material from all internet locations in which it appears
Indicate our intention to instigate legal proceedings if our requests are not met
