DEFAMATION, HARASSMENT, BUSINESS DEFAMATION
The Church
In this case, we represented the claimants. They were a husband and wife, and the husband was the General overseer of one of Nigeria’s largest Christian churches with over three million followers worldwide.
The defendant was a blogger who posted over two hundred false and defamatory videos and articles about the claimants. These were posted on Facebook, YouTube, Instagram and on the Defendant’s website. In particular, the first claimant alleged that the claimant had committed physical abuse, manipulation, fraud, sexual misconduct, and an allegation that his wife was not in fact the mother of their son. The attacks by the defendant were also made against the defendant’s church in efforts to destroy the credibility of the church. The defendant acted as a litigant in person and televised the trial on her channels in order to monetise these.
The claimants were awarded a judgement against the defendant and were awarded damages on summary judgment. The claimant’s success in this action also stopped any further defamation of the Church by the defendant.
Who Do I Sue for Internet Defamation?
The law is complex. Our focus in every case is to get the offending material taken down as quickly as we can. This includes seeking urgent removal from search engine results.
Our first step is to approach the person who posted the material (if known). We will also approach the publisher – the website operator or host – who may have an interest in removing material because of their potential liability under UK defamation law.
Our initial letter will:
State the precise nature of the defamation
Request the immediate removal of the material from all internet locations in which it appears
Indicate our intention to instigate legal proceedings if our requests are not met
